Facts in Brief:
The victim child was the student of Class seven, as per school certificate her age at the time of kidnapping is about 13 years 6 months. She was meritorious student of Barpa Hajee Nuruddin Bhuiya High School at Rupgonj Upazila. Her father and mother are destitute working as day laborer, living with hardship hiring a small house at the address at Tarail. On the other hand the perpetrator Masud Rana is a married man having three children and wife. In the locality he got bad reputation and many criminal cases are pending against him for his bribery, corrupt practices etc. Sometimes, he used to eve-tease this child for abduction. Ultimately on 12.03.2014 at about 11 a.m. while Rupa Rani was going to attend her class at Hajee Nuruddin Bhuiya School, the perpetrator along with Ms. Arjina (35) Bashed (40) son of Abdul Quddus, Ms.Shanti Begum (42) about 11 a.m. suddenly obstructed her and compelled her to board in a micro-bus and they decamped. At that time the victim cried loudly but nobody helped for her rescue. During kidnapping some of the witnesses namely 1) Nazir Ahmed (51), Ms. Monira Begum (32), 3) Ms.Austami Sarkar (16) 4) Ms.Fazila Begum, 5) Kanchan Ahmed and Apurba Pal saw the Micro Bus (without any number) fleeing towards unknown destination.
Legal Action:
Mr.Ranajit Pal, destitute father of the victim lodged F.I.R at Rupgonj police station on 17.03.2014 under section 7/30 of Women and Children Repression Act, 2003 against the perpetrators, but only accused No.3 Bashed was arrested after intervention of BDMW on 17.03.2014. All other perpetrators along with victim are not yet traceable by the police. The legal guardian of the victim is of the opinion that her child may be forcefully converted to Islam or may be sold out from Bangladesh for trafficking.
Investigation: –
I, along with Md.Mahabul Haque of BCHRD and Priyanjan Prova of BDMW proceeded towards the spot within Ruponj police station with the help of Sub Inspector- Fariduddin of Rupgonj police station; we talked with Md. Asaduzzaman-O.C Rupgonj Police station, he directed his subordinate police officer to accompany us at the spot. We met with Ms.Shandya Rani Pal- ailing mother of victim who was crying for rescue of her child, she also made an allegation against police that after a lapse of time although police entertained her case at the police station and they also demanded money to register the case from the destitute victim’s family. We also talked with those witnesses present at the time of our fact finding investigation, most of the witnesses gave us to understand that the accused Masud Rana (Bachu) is noted criminal in the locality and he married two women and he got three children. Mother of the victim showing us a photo of her child crying and said “please help me to recover my baby, she also said “we are helpless, very much poor but we husband and wife wanted to give education to our children, but all our aspirations have been nipped in the bud” Father of the victim who lodged the F.I.R. has become ill and not in a position to speak with us due to nervousness and distressed position. We noticed that both father and mother are suffering from acute diseases and paucity of fund they cannot purchase medicine for their survival and recovery from illness.
We also interrogated the Police Sub Inspector – Sheikh Fariduddin who gave us to understand that the other perpetrators are absconding and till today no trace has yet been made. He also assured that other perpetrators might be arrested for rescue of the victim child. But we also got information from the witnesses that Sheikh Fariduddin did never visit the place of occurrence nor tried to rescue the victim.
Recommendations:
Bangladesh Minority Watch is very much concerned at the incident of abduction of minor child and demand as follows:
1) The victim girl should be rescued and brought her before the court to hand over her to her father and mother.
2) The police officer who is responsible for delay in entertaining the F.I.R. from the informant should be brought to book departmentally as per law, as delay defeats equity and justice.
3) The perpetrators responsible for kidnapping and abduction should be brought to book as per law;
4) The responsible FIR named accused should be arrested very soon for proper adjudication of the matter and also for bringing the victim girl before the court.
5) Police should find out whether any documents purported to have been made by perpetrators to use those concocted documents at the time of trial of the case.
6) The Minorities should be protected from ethnic cleansing.
7) Corrupted police officer who demanded money from the victim’s family for legal assistance should be brought to book.
